Terms of use
kryiemand.co.za only introduces you to independent professionals and employers. We do not do the work, we do not employ the professionals, and we do not hold money on your behalf. By using the service you agree that we are not liable for theft, crime, violent or unlawful conduct, damage to property, injury, poor or unsafe work, non-payment, disputes or any other loss arising from your dealings with other users (clauses 5 to 10), and that you indemnify us against such claims (clause 11). These clauses limit your rights; please read them carefully.
1. Who we are and what we do
kryiemand.co.za is an introduction platform. We help customers show their request to professionals, we show professionals' offers, and we help job seekers and employers find each other. We are not the employer, contractor, agent, insurer, recruitment agency or arbiter of any user.
2. What "vetted" means
When we say a professional is "vetted", it only means we reviewed the documents the professional uploaded (such as ID, proof of address, bank confirmation and listed registrations) and they appeared in order to us. We do not run criminal background checks (unless we expressly say so), we do not inspect their work or tools, and we do not guarantee their competence, honesty, safety, price or availability. The same applies to customers, employers and job seekers: we cannot confirm who they really are or whether what they say is true.
3. Your agreement is with the other party
Any agreement about work, price, payment, warranty or employment is only between you and the other user. We are not a party to it. Prices and times are the professional's offer; confirm them in writing before work starts. We do not hold money in escrow and we do not guarantee payment or quality.
4. For customers
Please give accurate information. In an emergency (gas, fire, electrical danger, danger to people) call the emergency numbers first; we are not an emergency service. You are responsible for your own safety and property: check who arrives, stay with or leave a trusted person present while work is done, put valuables away, get a written price, preferably pay only when the work is finished and satisfactory, and be careful with large deposits or cash.
5. Crime, theft, damage and injury
We are not liable for any crime, theft, fraud, violence, harassment, damage to property or injury (or death) caused by any user or third party, including where it happens during or after contact made through our platform. You deal with other users at your own risk. Report crime to the SAPS; we may cooperate with law enforcement.
6. Non-payment and disputes
We are not liable if a user does not pay, pays late or disputes an amount, or if work is not done, is incomplete or unsatisfactory. Disputes are settled directly between the parties. We may, at our discretion and without obligation, try to help, review ratings or location data, or suspend users.
7. For professionals
You are an independent business and not our employee or agent. You declare that your documents and registrations are genuine and valid, that you comply with the law and industry standards (including required certificates such as an electrical CoC), that you handle your own insurance, tax and safety, and that you are solely responsible for your work, staff and tools. False documents lead to immediate suspension. We may pause a service category when a required document expires or is rejected. You may not steer customers off the platform to avoid fees.
8. Rating and blocking customers
Professionals can rate and block customers privately. Customers do not see their rating. Ratings are the professional's opinion, not ours, and we do not guarantee they are accurate. We may remove unfair or abusive ratings. A low rating may mean professionals decline your requests.
9. Job ads and CVs
Job ads and CVs are information that users supply themselves. We are not an employer or recruitment agency, we do not verify everything in ads or CVs, and we do not guarantee that a position exists, will be filled, or that a candidate is suitable or honest. Employers must comply with labour and equality law and must not ask job seekers to pay. Job seekers should never pay to get a job. You decide whom you hire or apply to.
10. No warranty; limitation of liability
The service is provided "as is". We do not guarantee that it is always available or error-free, or that you will get offers, work or candidates. To the extent the law allows, we are not liable for any direct, indirect or consequential loss, loss of profit or income, loss of data or any other loss arising from your use of the platform, other users or the work. Where the law does not allow a full exclusion, our total liability is limited to the greater of the fees you paid us in the previous 12 months and R[amount]. Nothing here excludes liability for fraud, wilful misconduct, gross negligence, or anything that cannot lawfully be excluded, including rights under the Consumer Protection Act.
11. Indemnity
You indemnify and hold harmless kryiemand.co.za, its owners, directors, employees and agents against all claims, losses, damages, penalties and costs (including attorney-and-own-client costs) arising from: your breach of these terms or the law; false or misleading information you provide; your acts or omissions; the work you do or have done; any dispute, non-payment, theft, damage or injury between you and another user or a third party; and content you upload. This includes claims made by third parties.
12. Opportunity fees and credit
Professionals pay an opportunity fee when they send an offer. Fees, refunds and credit rules are published here: [Fee policy]. In the demo, all credit is test credit with no real value.
13. Acceptable use and suspension
No fraud, harassment, discrimination, circumventing the platform to avoid fees, or uploading unlawful or false content. We may suspend or end access, remove content and cooperate with the authorities.
14. Changes
We may change these terms. Material changes get a new version number and you will be asked to accept them again before you continue to use the service.
15. Governing law
South African law applies. [Jurisdiction and dispute resolution]. Your consumer rights under South African law remain unaffected to the extent they cannot lawfully be excluded.
